Washington’s Lemon Law: Protecting Car Buyers from Defective Vehicles

Purchasing a new car should bring peace of mind—not endless trips back to the repair shop. Washington’s Lemon Law is designed to protect consumers who buy new vehicles that turn out to have serious defects. If your vehicle has recurring problems that a manufacturer cannot fix, you may be entitled to a replacement or refund. At the Law Office of Erin Bradley McAleer, we help consumers understand their rights and take the steps necessary to enforce them.

What Vehicles Are Covered?

Washington’s Lemon Law generally applies to new passenger vehicles, trucks, motorcycles, and certain motorhomes purchased or leased in Washington. Used vehicles may qualify only if they are still under the original manufacturer’s warranty and meet other statutory requirements.

When Is a Car Considered a “Lemon”?

A vehicle may qualify as a lemon if:

  • The manufacturer or its authorized dealers have made multiple unsuccessful repair attempts for the same defect, or
  • The vehicle has been out of service for an extended period due to repairs, or
  • A serious safety defect cannot be corrected.

The defect must substantially impair the use, value, or safety of the vehicle. Minor issues or cosmetic problems do not qualify.

The Resolution Process

Before taking formal legal action, Washington law requires that consumers give the manufacturer a reasonable opportunity to repair the vehicle. If repairs are unsuccessful, the consumer may request arbitration through the Washington State Attorney General’s Office Lemon Law program.

If arbitration is successful, the manufacturer may be required to replace the vehicle with a new one or refund the purchase price, less a reasonable allowance for use. If arbitration does not resolve the matter, consumers may pursue remedies in court.

The Lemon Law process can be intimidating, especially when dealing with manufacturers who often resist buybacks or replacements. An experienced attorney can help you present your case clearly, gather the necessary documentation, and protect your rights in arbitration or litigation.
